3. General terms and conditions of sale

Unless specific terms have been expressly agreed with the client, the services provided by 5AM LOGISTICS are governed by the General Terms and Conditions of Union TLF – December 2022 version, in particular as regards the principal’s obligations, payment terms, limitations of liability, limitation periods and the settlement of disputes.

The specific terms set out in a quotation, commercial offer, engagement letter or accepted transport order prevail over the general terms and conditions for the provisions specific to them.

4. Consumer mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, any client who qualifies as a consumer may use a consumer mediation scheme free of charge with a view to the amicable settlement of a dispute with 5AM LOGISTICS.

Before referring the matter to the mediator, the consumer must have sent a written complaint to 5AM LOGISTICS at the following address:

If the consumer is not satisfied with the answer provided, or if no answer is given, the consumer may refer the matter to the mediator within one year of the written complaint.

5AM LOGISTICS has appointed, under membership number 19666/VM/2609, the company SAS Médiation Solution as its consumer mediation body.

The request must in particular include the applicant’s contact details, 5AM LOGISTICS’ references and membership number, a statement of the dispute, a copy of the prior complaint and the documents needed to examine the case.

This consumer mediation scheme does not apply to disputes between professionals.

5. Intellectual property

The website, its structure and all of its content, including texts, photographs, illustrations, graphic elements, logos, trademarks, videos, databases and downloadable documents, are protected by intellectual property law.

Unless prior written authorisation has been given by 5AM LOGISTICS or the holder of the rights concerned, any reproduction, representation, adaptation, modification, distribution or use, in whole or in part, of these elements is prohibited, whatever the medium or process used.

Consulting the website only confers a personal, private and non-exclusive right of use.

Some visual elements come from image banks, in particular Shutterstock, or have been produced, acquired or used with the authorisation of their owners. Specific credits are indicated where required.

The information published is, however, of a general nature and does not replace a tailored study of your case, in particular as regards transport, customs, taxation, regulatory compliance or international trade.

Only quotations, rates, specific terms, engagement letters and instructions that have been expressly accepted have contractual value.

The website may contain links to websites or services operated by third parties. 5AM LOGISTICS has no control over their content, availability or data protection practices.

8. Data that may be collected

Depending on the services used, 5AM LOGISTICS may in particular collect:

• surname, first name and professional or personal contact details;
• company name, position and billing information;
• the information needed to examine a transport, customs or consulting request;
• the characteristics of the goods, routes, Incoterms, weights, dimensions, values and documents provided;
• exchanges, instructions, complaints and requests sent to 5AM LOGISTICS;
• technical browsing data, IP address, connection logs and cookie choices;
• the e-mail address provided to subscribe to a newsletter.

Mandatory form fields are identified as such. If this information is not provided, 5AM LOGISTICS may be unable to process the request.

Users are asked to send only the documents and data strictly necessary to examine or carry out their case.

9. Purposes and legal bases

The data is processed in particular to:

• answer contact, information and quotation requests;
• assess the feasibility of a transport, customs or logistics operation;
• prepare and perform the services requested;
• communicate with clients, prospects, suppliers, carriers, agents and the competent authorities;
• ensure the operational, administrative, accounting and litigation follow-up of files;
• comply with legal, tax, customs, regulatory and trade-control obligations;
• prevent fraud, security breaches and misuse of the website;
• send commercial information where permitted;
• measure the audience and improve the operation of the website, subject to the consent required.

Depending on the purpose pursued, the processing is based on:

• the performance of pre-contractual measures taken at the request of the person;
• the performance of a contract;
• compliance with a legal or regulatory obligation;
• the legitimate interest of 5AM LOGISTICS in ensuring the operation, security and development of its business;
• the person’s consent, in particular where it is required for electronic marketing or non-essential trackers.

No decision producing legal effects is taken solely on the basis of automated processing.

10. Recipients of the data

The data is accessible, within the limits of their duties, to the authorised staff of 5AM LOGISTICS and to the service providers acting on its behalf.

Where an operation so requires, the data may also be passed on to carriers, shipping or airline companies, agents, handlers, warehouse keepers, customs representatives, insurers, advisers, IT service providers, customs, tax, health, port or airport authorities or any other competent authority.

5AM LOGISTICS does not sell the personal data collected on its website.

11. International data transfers

Given the international nature of transport and customs services, some data may be transferred to recipients located outside the European Economic Area where this is necessary to examine or carry out the requested operation.

These transfers are governed in accordance with the GDPR, in particular by an adequacy decision, standard contractual clauses or, in the specific situations provided for by the GDPR, where they are necessary for the performance of the contract or the implementation of pre-contractual measures requested by the data subject.

Some technical service providers may also process data outside the European Economic Area in accordance with the safeguards provided for by the applicable regulations.

12. Retention periods

Data is kept only for as long as necessary for the purpose pursued, and is then deleted or securely archived.

As a guide:

• data relating to a prospect is kept for three years from its collection or from the last contact initiated by the prospect;
• data and documents provided for a quotation request not followed by an operation are deleted or anonymised when they are no longer needed and, in principle, within a maximum of twelve months for technical or customs documents;
• data relating to clients is kept for the duration of the contractual relationship, then for as long as necessary to defend the rights of 5AM LOGISTICS;
• invoices and accounting documents are kept for ten years;
• transport, customs, tax and regulatory documents are kept for the periods required by the applicable legislation;
• data used for marketing purposes is kept for three years from the last contact or the end of the business relationship;
• audience-measurement data collected by Matomo is kept for twenty-five months at most, then deleted automatically;
• cookie choices are, in principle, kept for six months.

These periods may be extended where required by law or where the data is necessary for the establishment, exercise or defence of legal claims.

13. Your rights

Under the conditions provided for by the regulations, you may request:

• access to your data;
• its rectification;
• its erasure;
• the restriction of its processing;
• its portability;
• to object to certain processing, in particular commercial marketing;
• to withdraw your consent at any time where the processing is based on it;
• to set guidelines on what happens to your data after your death.

To avoid any disclosure to an unauthorised person, proof of identity may be requested in the event of reasonable doubt as to the identity of the applicant.

You may also lodge a complaint with the French data protection authority (Commission nationale de l’informatique et des libertés – CNIL) on the website www.cnil.fr or by post at: CNIL, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France.

14. Cookies and other trackers

A cookie or tracker is a file or identifier that may be stored on or read from the user’s device when visiting a website.

The website uses the following categories:

• strictly necessary trackers, essential for the operation and security of the website and for keeping your privacy choices;
• preference trackers, in particular to remember the display language;
• audience-measurement trackers, through Google Analytics (subject to consent) and Matomo, which is self-hosted and configured without cookies and falls under audience measurement exempt from consent (see below);
• advertising and conversion-measurement trackers, through Google Ads tags loaded via Google Tag Manager and the OpenAI Ads pixel;
• security trackers protecting against automated submissions, through Google reCAPTCHA on our forms;
• embedded third-party content: the customer reviews displayed on the website are provided by Trustfolio (share.trustfolio.co); no cookie has been observed.

Matomo audience measurement and right to object. Matomo is used solely to produce anonymous statistics on website traffic (number of visits, pages viewed, visitor sources). In line with the recommendations of the CNIL (French data protection authority), it sets no cookie, the IP address is anonymised before being recorded, no individual tracking of visitors takes place, the data is neither combined with other processing nor passed on to third parties, and it is deleted after twenty-five months. You can object to this measurement at any time, below or via the “Manage my cookies” link:

Google Tag Manager is a tag-management tool. The tags it triggers are only activated in accordance with the choice expressed by the user (Google Consent Mode).

With the exception of strictly necessary or legally exempt trackers, no tracker is stored or read before the user has given consent.

On the first visit, the user can:

• accept all;
• refuse all;
• customise their choices.

Refusing is as easy as accepting. Not answering or continuing to browse does not constitute consent.

Choices can be changed or withdrawn at any time using the permanent “Manage my cookies” link available at the bottom of every page. They are kept for six months.

The detailed list of trackers, their provider, purpose and retention period is given below and remains accessible from the “Manage my cookies” tool.

Links to Facebook, LinkedIn, Instagram or other social networks do not, by themselves, cause these platforms to set cookies. When the user clicks on one of these links, they leave the 5AM LOGISTICS website and become subject to the privacy policy of the platform concerned.
